If you are a resident of Nevada or Washington, you may have rights with respect to the limited data YMCA of the USA and its affiliates and subsidiaries (“YMCA of the USA,” “we,” “us,” or “our”) collect that is deemed “Consumer Health Data” under laws in these states.  This Consumer Health Data Notice applies only to data that we treat as Consumer Health Data under the Nevada consumer health data law (“NCHD”) and the Washington My Health My Data Act (“WMHMDA”) (collectively, “CHD Laws”).  Please see our Privacy Notice for additional information about how we collect, use, and share non-Consumer Health Data.

YMCA of the USA also provides some services regulated by the Health Insurance Portability and Accountability Act (“HIPAA”) to HIPAA “covered entities,” such as when we receive patient information from providers about individuals referred to the YMCA Diabetes Prevention Program. This HIPAA-regulated Protected Health Information (“PHI”) is not covered by the Consumer Health Data Privacy Notice.

CONSUMER HEALTH DATA COLLECTION

You may provide YMCA of the USA information about yourself or your child that is considered Consumer Health Data under CHD Laws.  We may collect the following information:

  • Provider information.  Information about your current health care or insurance provider, including physician name and contact information, insurance plan provider, and insurance policy number.
  • Accommodations information.  Information about any allergies, food sensitivities or restrictions, or accommodations that may be needed.  This information may include information about specific health conditions.  

SOURCES

YMCA of the USA may receive this information directly from you or from local chapters or affiliates that enter this information into our event database.  For instance, we may collect Consumer Health Data when you register for a program or event, participate in sports programs or events, or otherwise provide Consumer Health Data to us. 

OUR PURPOSES

Our purposes for collecting Consumer Health Data are to administer the programs and events for which you register, including by maintaining contact information about your health provider and insurance coverage in case of emergency at an event or program and identifying any dietary or other accommodations you or your child may need at our events or programs. 
We may use this data for business and commercial purposes that are necessary to provide services you have requested such as to communicate with you or your provider, to set up and maintain your account with us, to manage our relationship with you, to comply with law, to protect the health and safety of our event and program participants, or with your consent or as otherwise disclosed at the time of collection.  We do not use Consumer Health Data for marketing or advertising purposes.

RECIPIENTS OF CONSUMER HEALTH DATA

We may provide this data to our affiliates, local YMCA chapters, and services providers, or to your health care providers, in order to administer the programs and events for which you have registered.  Additionally, we do not “sell” Consumer Health Data, as that term is defined by CHD Laws.

CONSUMER HEALTH DATA RIGHTS

Nevada and Washington residents have certain rights with respect to Consumer Health Data we collect.  If you are a Nevada or Washington resident, you may choose to exercise the following rights regarding Consumer Health Data we collect about you, subject to certain exceptions and limitations:

  • The right to confirm whether we are collecting, sharing, or selling Consumer Health Data about you.  As described above, YMCA of the USA does not “sell” Consumer Health Data, as that term is defined by the CHD Laws.
  • The right to access Consumer Health Data we collected about you, including the right to access a list of all third-party recipients of Consumer Health Data about you.
  • The right to request that we deletethe Consumer Health Data we have collected about you.
  • The right to withdraw consent to the collection or sharing of Consumer Health Data about you. Please note that if you cease our collection or sharing of Consumer Health Data, we may be unable to provide you with some services.
  • The right not to receive discriminatory treatment for the exercise of the above rights.
